1. DEFINITIONS

The terms used in these Regulations mean:

1.1. PASSWORD - a string of alphanumeric characters necessary for authorization when accessing the Account, determined independently by the Customer during the Registration process.

1.2. CUSTOMER - a natural person with full legal capacity, and in cases provided for by generally applicable regulations also a natural person with limited legal capacity; a legal person or an organizational unit without legal personality, which the law grants legal capacity, and which intends to conclude or has concluded a Sales Agreement or an Agreement for the provision of Electronic Services.

1.3. CIVIL CODE - the Civil Code Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended, Polish Law).

1.4. CONSUMER - a natural person for whom the conclusion of the Sales Agreement or contract for the provision of Electronic Services is not directly related to its business or professional activity.

1.5. ACCOUNT (CUSTOMER ACCOUNT) - a subpage of the Store, within which, among others, information about the Customer's Orders in the Online Store is collected.

1.6. PRODUCT - a movable item available in the Online Store which is the subject of the Sales Agreement between the Customer and the Seller.

1.7. REGULATIONS - these Regulations of the Online Store.

1.8. REGISTRATION - a one-time activity consisting in creating an Account by the Customer, made using the registration form provided by the Service Provider on the Store's website.

1.9. ONLINE STORE (STORE) - the Service Provider's online store available at www.gakker.pl through which the Customer may conclude a Sales Agreement or an Electronic Service Statement Agreement.

1.10. SELLER - Jakub Garkowski running a business under the name NIBRES Jakub Garkowski (business address: ul. Mistrzowska 4/8, 01-929 Warsaw) entered into the Central Register and Information on Economic Activity of the Republic of Poland kept by the minister competent for economy, NIP 545 -167-31-75, REGON 364359265, e-mail address: gakker.pl@gmail.com, telephone number: (+48) 519 507 481 (fee as for a standard call - according to the price list of the relevant operator).

1.11. PARTY - Service Provider, Seller or Customer.

1.12. SALES AGREEMENT (AGREEMENT) - a Product sales agreement within the meaning of the Civil Code concluded via the Online Store.

1.13. ELECTRONIC SERVICE - a service provided electronically by the Service Provider via the Online Store.

1.14. SERVICE PROVIDER - Jakub Garkowski running a business under the name NIBRES Jakub Garkowski (address of business: ul. Mistrzowska 4/8, 01-929 Warsaw) entered into the Central Register and Information on Economic Activity of the Republic of Poland kept by the minister responsible for economy, NIP 545 -167-31-75, REGON 364359265, e-mail address: gakker.pl@gmail.com, telephone number: (+48) 519 507 481 (fee as for a standard call - according to the price list of the relevant operator).

1.15. ORDER - Customer's declaration of intent aimed directly at the conclusion of the Product Sales Agreement and specifying its essential terms.

2. GENERAL PROVISIONS

2.1. The provisions of these Regulations are not intended to exclude or limit any rights of the Customer who is also a Consumer under the mandatory provisions of law. In the event of non-compliance of the provisions of these Regulations with the above provisions, these provisions shall prevail.

2.2. The Regulations define the rules of using the Online Store by Customers.

2.3. These Regulations are the regulations referred to in Art. 8 of the Act of July 18, 2002 on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204, as amended), and also regulates the conditions for concluding Sales Agreements in the Online Store.

2.5. The Service Provider provides the following Electronic Services via the Online Store:

2.5.1. Customer Account in the Online Store;

2.5.2. An interactive form that allows customers to place an Order in the Online Store.

2.5.3. Newsletter.

2.6. The minimum technical requirements necessary to work with the ICT system used by the Service Provider:

2.6.1. A computer with Internet access;

2.6.2. Access to e-mail.

2.6.3. Recommended monitor resolution: 1024x768 pixels;

2.6.4. Internet browser: Internet Explorer version 7.0 or newer with enabled JavaScript and cookies; Mozilla Firefox version 3.0 or newer with JavaScript and cookies enabled; or Google Chrome 8 or later.

2.7. The customer is prohibited from delivering illegal content.

2.8. The customer is obliged to enter data consistent with the facts.

2.9. The Customer is obliged to use the Online Store in a manner consistent with the law and morality, with respect for personal rights and intellectual property rights of third parties.

2.10. In order to ensure the security of the transmission of messages, the Service Provider takes technical and organizational measures appropriate to the degree of threat to the security of the Electronic Service provided.

3. CONDITIONS FOR CONCLUDING A SALE AGREEMENT

3.1. Announcements, advertisements, price lists and other information about the Products provided on the websites of the Online Store, in particular their descriptions, technical and performance parameters and prices, constitute an invitation to conclude a contract, within the meaning of art. 71 of the Civil Code.

3.2. The Product price shown on the Online Store website is given in Polish zlotys and includes all components, including VAT and customs duties. The prices of the Products, however, do not include delivery costs, which - if any - are indicated when placing the Order and are available on the Online Store website in the Payment and delivery tab at: www.gakker.pl/pl/i/platnosci-i-dostawa/ 3

3.3. The Product price shown on the Online Store website is binding at the time of placing the Order by the Customer. This price will not change regardless of price changes in the Online Store, which may occur for individual Products after the Customer places an Order.

3.4. In order to conclude a Product Sales Agreement using an interactive form, go to the website of the Online Store, select the Product and submit an Order using the interactive form based on the messages and information displayed to the Customer.

3.4.1. When placing the Order, the following data necessary to place the Order should be provided: name and surname, address (street, house number, town and postal code), contact telephone number, Product, quantity of the Product, place and method of delivery of the Product, method of payment.

3.5. Placing an Order via the interactive form takes place when you click the "Order" field in the form.

3.6. After placing the Order, the Seller immediately (1) confirms its receipt, which binds the Customer with his statement and (2) accepts the Order for execution - at this point, the Sales Agreement is concluded. Confirmation of receipt of the Order and its acceptance for implementation takes place by sending the Customer an appropriate message to the e-mail address provided during the ordering process (e-mail address).

3.7. When placing an Order using the interactive form - until the Order is placed - the Customer has the option of modifying the entered data. For this purpose, follow the displayed messages and information available on the website of the Online Store.

4. DELIVERY

4.1. In the event of concluding a Sales Agreement, the Product will be shipped no later than on the date specified when purchasing a given product, counting from the date on which the Sales Agreement was concluded.

4.2. The Seller will deliver Products according to the Customer's choice:

4.2.1. via InPost courier while placing the Order (within 48 hours of product shipment).

4.3. Delivery of Products is available on the territory of: the Republic of Poland.

4.4. Delivery costs will be clearly indicated during the ordering process and are available on the Online Store website in the Payments and delivery tab at: https://gakker.eu/en_GB/i/Payments-and-Shipping/21.

4.5. Shipment takes place only on working days.

4.6. If the customer chooses the method of payment by bank transfer or payment card, the order processing time is counted from the date of crediting the Seller's bank account or settlement account.

If there is a need to return funds for a transaction made by the customer with a payment card, the seller will be refunded to the bank account assigned to the payment card of the Ordering Party.

If the customer chooses the method of payment by bank transfer or payment card, the order processing time is counted from the date of crediting the Seller's bank account or settlement account.

5.2. In the case of a payment method other than cash on delivery, the Customer is obliged to pay the price under the Sales Agreement within 7 days from the date of its conclusion, unless the Sales Agreement provides otherwise.

5.3. In the case of Customers who are not Consumers at the same time, the Seller has the right to limit the available payment methods, including requiring a prepayment in whole or in part.

6. RIGHT TO WITHDRAW FROM THE CONTRACT

6.1. A Customer who is also a Consumer, who has concluded a Sales Agreement or an Agreement for the provision of Electronic Services, may withdraw from it without giving reasons, by submitting an appropriate statement in writing within fourteen days. To meet this deadline, it is enough to send a statement before its expiry. The above right may be exercised by the Consumer by sending a declaration of withdrawal to the following address: NIBRES Jakub Garkowski, ul. Mistrzowska 4/8, 01-929 Warsaw.

6.2. The fourteen-day period during which the Consumer may withdraw from the Sales Agreement or the contract for the provision of Electronic Services is counted from the date of the Product release in the case of a Sales Agreement, and if the contract concerns the provision of Electronic Services - from the date of its conclusion.

6.3. In the event of withdrawal from the contract, the sales contract or contract for the provision of electronic services is considered void and the customer is released from any obligations. What the Parties provided shall be returned unchanged, unless the change was necessary within the limits of ordinary management. The return should be made immediately, not later than within fourteen days. If the Consumer has made any prepayments, statutory interest is due on them from the date of prepayment.

6.4. The Seller will return to the bank account number indicated by the Consumer or in another way indicated by the Consumer.

6.5. The right to withdraw from a distance contract is not entitled to the Consumer in the following cases: (1) the provision of services commenced, with the consent of the consumer, before the deadline referred to above in points 7.1 and 7.2; (2) concerning audio and visual recordings and recorded on IT data carriers after the consumer has removed their original packaging; (3) benefit contracts for which the price or remuneration depends solely on the movement of prices in the financial market; (4) services with the properties specified by the consumer in his order or closely related to his person; (5) services which, due to their nature, cannot be returned or whose subject quickly deteriorates; (6) providing a press; (7) gambling services.

6.6 Notice of withdrawal from the contract.

7. THE COMPLAINT PROCEDURE

7.1. Complaints for non-compliance of the Product with the Sales Agreement

7.1.1. The Seller is liable to the Customer who is a natural person who purchases the Product for purposes unrelated to professional or business activities, for the Product's non-compliance with the Sales Agreement to the extent specified in particular by the Act of 27 July 2002 on specific terms of consumer sale and amending the Civil Code. (Journal of Laws No. 141, item 1176 as amended).

7.1.2. Complaints for non-compliance of the Product with the Sales Agreement may be submitted in writing to the address: ul. Mistrzowska 4/8, 01-929 Warsaw or via e-mail to the following address: gakker.pl@gmail.com.

7.1.3. The seller will respond to the complaint immediately, no later than within 14 days. The Seller's response to the complaint is sent to the address provided by the Customer or in another manner provided by the Customer.

7.1.4. The Seller informs that in the case of Products also covered by the warranty, the rights in this respect should be exercised in accordance with the conditions set out in the warranty card. The warranty for the sold Product does not exclude, limit or suspend the Customer's rights under the Seller's liability for non-compliance of the Product with the Sales Agreement to the extent specified by the Act of July 27, 2002. on special conditions of consumer sale and on the amendment of the Civil Code (Journal of Laws No. 141, item 1176, as amended).

7.2. Complaints related to the provision of Electronic services and other complaints related to the operation of the Online Store

7.2.1. Complaints related to the provision of Electronic Services and other complaints related to the operation of the Online Store may be submitted in writing to the address ul. Mistrzowska 4/8, 01-929 Warsaw or via e-mail to the following address: gakker.pl@gmail.com

7.2.2. It is recommended to provide in the content of the complaint as much information and circumstances as possible regarding the subject of the complaint, in particular the type and date of the irregularity and contact details - this will facilitate and accelerate the consideration of the complaint by the Service Provider.

7.2.3. The complaint will be considered by the Service Provider immediately, no later than within 14 days.

7.2.4. The Service Provider's response to the complaint is sent to the Customer's e-mail address provided in the complaint or in another manner provided by the Customer.

7.2.5. The consumer may use extrajudicial means of dealing with complaints and redress. In order to take advantage of the possibility of amicable settlement of disputes regarding online purchases, the Consumer may submit his complaint, e.g. via the EU ODR internet platform, available at: http: //ec.europa.eu/consumers/odr/

8. PERSONAL DATA

8.1. The administrator of the Customer's personal data collected via the Online Store is: Jakub Garkowski running a business under the name NIBRES Jakub Garkowski (business address: ul. Mistrzowska 4/8, 01-929 Warsaw) entered into the Central Register and Information on Economic Activity of the Republic of Poland conducted by the minister responsible for economy, NIP 545-167-31-75, REGON 364359265, e-mail address: gakker.pl@gmail.com ,.

8.2. The Customer's personal data collected by the Administrator via the Online Store are collected in order to implement the Sales Agreement or contract for the provision of Electronic Services and receive commercial information in the form of a Newsletter.

8.3. The customer has the right to access their data and correct them.

8.4. Providing personal data by the Customer is voluntary, but failure to provide the personal data specified in the Regulations necessary to conclude a Sales Agreement or an Agreement for the Provision of Electronic Services results in the refusal to conclude this agreement. The data necessary to conclude a Sales Agreement or an Agreement for the provision of Electronic Services are also indicated each time on the website of the Online Store.

9. FINAL PROVISION

9.1. Agreements concluded through the Online Store are concluded in Polish.

9.2. In matters not covered by these Regulations, the provisions of the law in force in the territory of the Republic of Poland, including the Civil Code, the Act on the provision of electronic services of July 18, 2002 (Journal of Laws No. 144, item 1204, as amended); The Act on the protection of certain consumer rights and liability for damage caused by a dangerous product of March 2, 2000 (Journal of Laws No. 22, item 271, as amended); Act on special conditions of consumer sales and amending the Civil Code of 27 July 2002 (Journal of Laws No. 141, item 1176, as amended) and other relevant provisions of Polish law. 9.2.1. The choice of Polish law does not deprive the consumer of the protection granted to him on the basis of provisions that cannot be excluded by contract, under the law that would be applicable in the absence of a choice, i.e. the law of the country where the consumer has his habitual residence and the entrepreneur (1) performs his business or profession in the country where the consumer has his habitual residence; or (2) by any means, directs such activities to that country or to several countries including that country; and the contract falls within the scope of this activity.

9.3. Customers can access the Regulations at any time via the link on the main page of the Online Store and download it and print it out. The Regulations of the Online Store are available at: www.gakker.pl/pl/i/regulamin and are provided free of charge to the Customer (by electronic means) at his request.

9.4. Consolidating, securing and providing the Customer with the content of the concluded Sales Agreement and the Agreement for the provision of Electronic Services takes place through (1) providing the Regulations on the pages indicated in point 10.3 and (2) sending the Customer an e-mail, and in the case of a Sales Agreement also by (3) attaching a proof of purchase to the parcels.

9.5. Disputes arising between the Service Provider, the Seller and the Customer, who is also a Consumer, shall be submitted to the competent common courts. Disputes arising between the Service Provider, the Seller and the Customer who is not also a Consumer shall be submitted to the court having jurisdiction over the seat of the Service Provider or the Seller.
